Marijuana (Cannabis) Awareness
In the United States, it has become increasing common to have laws and policies allowing medical or recreational use of marijuana or cannabis within each state and municipality.
But to date, possession of marijuana (cannabis) is illegal under federal law and is still strictly regulated by federal authorities.
According to a report by the Congressional Research Services, updated May 2024, marijuana’s status is still a Schedule I controlled substance. A Schedule I controlled substance classification indicates that marijuana has high risk of abuse and no currently accepted medical use.
The Department of Enforcement Administration (DEA) has proposed moving marijuana from Substance I to Substance III, but this still would not bring recreational use into compliance with the CSA.
It can be confusing with each state developing their own regulations regarding the use of and decriminalization of marijuana (cannabis).
Let’s look at some facts.
The Facts about Marijuana (Cannabis) at the time of this post
- Marijuana is a psychoactive drug
- In general, consists of leaves and flowers of the cannabis sativa plant
- It is a Schedule I controlled substance and is strictly regulated by the federal authorities
- The Controlled Substance Act (CSA) prohibits manufacturing, distribution, dispensation, and possession except in federal government approved research studies
- In April 2024, the Drug Enforcement Administration (DEA) proposed moving marijuana from Schedule I to Schedule III under the CSA
The US Food and Drug Administration (FDA) has not approved marijuana for treating any health conditions
However, the FDA has approved two prescription medicines that contain man-made cannabinoids.
– Dronabinol (Marinol): This drug treats nausea and vomiting caused by chemotherapy and loss of appetite and weight loss in people with HIV/AIDS.
– Nabilone (Cesamet): This drug treats nausea and vomiting caused by chemotherapy in people who have not had relief from other treatments.
Unlike medical marijuana, the active ingredient in these drugs can be controlled, so you always know how much you get in a dose.

Possible mental or emotional side effects include:
- A strong feeling of happiness or well-being

- Increased anxiety
Providers are not allowed to prescribe medical marijuana to people younger than age 18.
People who should not use medical marijuana include:
- People with heart disease
- Pregnant women
- People with a history of psychosis
Other concerns linked to marijuana use include:
- Dangerous driving or other risky behaviors
- Lung irritation
- Dependence or addiction to marijuana
Problems with Regulating Marijuana (Cannabis)
- There is no unified set of rules regulating marijuana (cannabis)
- Some states are legalizing marijuana before setting safety controls in place
- Driving while under the influence of cannabis is at present difficult to determine thereby can be a problem enforcing
- Smoking marijuana in public needs to be carefully looked at, since other people and animals are being affected by the smoke
- Regulating employees
Personally, I have noticed problems in regulation.
- People smoking marijuana when driving
- Dogs noticeably being affected by marijuana smoke
- Construction workers smoking marijuana while working and using construction equipment
In general, smoking marijuana in the state of New York follows the guidelines of smoking cigarettes.
As per scientific research, secondhand cigarette smoke can cause health risks and problems to others.
This can be a very important issue in apartment complexes, office buildings, etc, since it is known that smoke will travel through floors, through vents, etc.
At present time, we don’t know all what marijuana smoke can do to others breathing it in.
Not everything has a simple solution. Many people believe that marijuana should be classified the same as alcohol. I am not convinced that is the solution.
